ZEKAVEO Libraries – Terms of Service

Welcome to ZEKAVEO Libraries. These Terms of Service ("Terms") govern your access to and use of the ZEKAVEO Libraries website, online store, digital products, and related services (collectively, the "Services").

By accessing our website, creating an account, or purchasing any Product from ZEKAVEO Libraries, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, you must not use the Services.

1. Eligibility

By using the Services, you confirm that you have the legal capacity to enter into a binding agreement under the laws applicable in your jurisdiction.

If you are purchasing Products on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms.

2. Digital Products

ZEKAVEO Libraries provides downloadable digital audio products, including but not limited to sound effects, music, audio assets, and related content. All Products are delivered electronically. No physical products are shipped.

Access to purchased Products is provided after successful payment has been processed through our authorized sales platform.

3. Orders and Payment

All prices are displayed in the applicable currency shown at checkout. Payment must be successfully completed before download access is granted.

ZEKAVEO Libraries reserves the right to refuse, suspend, or cancel any order where fraud, unauthorized payment activity, or other unlawful conduct is reasonably suspected. Applicable taxes may be collected where required by law.

4. Product Licensing

The purchase of any Product grants a license to use that Product in accordance with the applicable ZEKAVEO End User License Agreement (EULA).

Ownership of all Products remains with ZEKAVEO. Purchasing a Product does not transfer ownership or copyright.

The EULA forms part of these Terms and should be read before using any Product.

5. Refund Policy

All purchases are subject to the ZEKAVEO Libraries Refund Policy.

Due to the digital nature of our Products, purchases are generally non-refundable once download access has been granted, except where required by applicable consumer law.

6. Intellectual Property

All content available through ZEKAVEO Libraries, including but not limited to:

Sound libraries
Audio recordings
Music
Product names
Logos
Branding
Website design
Product descriptions
Images
Documentation

is protected by copyright and other intellectual property laws.

Except as expressly permitted under the applicable EULA, no content may be copied, reproduced, distributed, modified, or otherwise used without prior written permission from ZEKAVEO.

7. Acceptable Use

You agree not to:

Use the Services for any unlawful purpose.
Attempt to gain unauthorized access to the website or related systems.
Upload or distribute malicious software or harmful code.
Interfere with the security or operation of the Services.
Misrepresent your identity or engage in fraudulent activity.

8. Artificial Intelligence and Machine Learning Restrictions

Unless expressly authorized in writing by ZEKAVEO, you may not use any content made available through the Services, including but not limited to sound libraries, audio recordings, music, source files, metadata, documentation, product descriptions, images, or other materials, in whole or in part, for the purpose of:

Training, developing, fine-tuning, validating, or evaluating any artificial intelligence (AI), machine learning (ML), deep learning, neural network, or similar computational model or system.
Creating datasets intended for AI or machine learning applications.
Using the Products or any portion thereof as input for generative AI systems designed to create audio, music, sound effects, voices, or other derivative content.
Providing, uploading, distributing, or otherwise making any ZEKAVEO content available to any third party for AI training, research, or commercial AI development.

These restrictions apply regardless of whether the content has been modified, processed, combined with other materials, or incorporated into a larger dataset.

Any unauthorized use of ZEKAVEO content for artificial intelligence or machine learning purposes constitutes a material breach of these Terms and may result in the immediate termination of any applicable licenses or access rights, in addition to any other remedies available under applicable law.

9. Third-Party Services

ZEKAVEO Libraries may sell Products through third-party platforms, including but not limited to Shopify, ASoundEffect, Gumroad, itch.io, and similar digital marketplaces. Your use of those services may also be subject to their respective terms, conditions, and privacy policies.

ZEKAVEO Libraries is not responsible for the operation, availability, or policies of third-party platforms.

10. Website Availability

While reasonable efforts are made to maintain uninterrupted access to the Services, ZEKAVEO Libraries does not guarantee that the website or any associated services will always be available, secure, or free from errors.

Temporary interruptions may occur due to maintenance, technical issues, or circumstances beyond our reasonable control.

11. Disclaimer

The Services and all Products are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, except where such warranties cannot legally be excluded.

ZEKAVEO Libraries makes no guarantee that any Product will be suitable for your particular workflow, software, hardware, or intended purpose.

12. Limitation of Liability

To the fullest extent permitted by applicable law, ZEKAVEO Libraries shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, business interruption, loss of data, or loss of business opportunities arising from the use of, or inability to use, the Services or Products.

Nothing in these Terms excludes or limits any rights that cannot legally be excluded under applicable consumer protection laws.

13. Changes to These Terms

ZEKAVEO Libraries reserves the right to update or modify these Terms at any time.

Updated versions will become effective upon publication on the ZEKAVEO Libraries website. Continued use of the Services after changes are published constitutes acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law principles. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Australia.
